Management Corporation Strata Title Plans, or MCSTs, are the governing bodies of condominiums and other multiple ownerships properties where residents share common facilities such as swimming pools, gyms and open recreational areas. The usage and sharing of these common facilities are oftentimes the cause of disputes among residents/owners. Examples of the kinds of disagreements that can arise are common areas violations, property maintenance and security services issues, controversial actions by management associations, and disputes with developers over defects in workmanship or materials. The outcome of these disputes can have lasting and far-reaching effects on the operation of the estate.
Resolution on these types of issues requires a thorough understanding of applicable legislation, including the Building Maintenance and Strata Management Act (BMSMA). Vita Corporation has a network of legal advisors that for a fee will provide the property’s Management Council with an assessment of various issues as they arise. Although they are available to represent ownership in legal actions that may arise, owners are under no obligation to engage their services.
